Despite vessel’s readiness to discharged cargoes of sun flower seed oil by 0530 hours LT on the date of 21th of july 2011, vessel is waiting at anchorage for discharging is delayed untill 22. July 2011 at 1300hours LT. and Then waited , the Notice of Tendered accepted and signed by received on 22.july 2011 at 1900 hours LT

Due to this reason I hereby reserve my Owners/Disponent Owners’ right to claim for all costs and inconveniences they may have encountered, for the time lost, for idle attendance of all third parties concerned and/or vulnered, and for all and any other expenses deriving from the unreadiness of your Terminal/Factory to accomodate the vessel.

Dear Sirs,

Preliminary outturn figures as presented to me shortly after completion of discharge indicate an alleged shortage of 6,651 mts cargo of WHITE SIPIRIT for which the vessel is not responsible as derives from the following:
a) All measurements,surveys,inspections etc.,on arrival were carried out by all parties concerned.
b) The R.O.B. survey was very thorough and complete and leaves no doubt that all cargo was pumped out.
c) Cargo discharged as per ship's figures amounts to 2011063mts.
d) B/L figures 1999,146 mts
e) Ship figures at loading port 2000,182 mts.
f) Outturn figures at discharging port 1992,495 mts
In addition to the above,in order to alleviate vessel of any responsibility, I hereby invite you to carry out any additional inspection etc., you deem necessary whilst the vessel is at yours.

On behalf of my Owners/Operators,charterers and P+I Club, I repudiate any responsibility for short delivery and I am advising them accordingly in order to take the necessary steps.

Dear Sirs,

Despite the fact that you have stated in your heating instructions which issued to me by your SGS cargo surveyors, that the cargo is to be carried at temperatures between 80-90 degrees centigrade, but the maintaining temperature of the cargo should be max. 75 C degree despite loading temperature max.85 C degree as per charter party agreement dated 18.10.2002.

Due to the aforementioned reason I guarantee to maintain the temperature of stated in the charter party (75 C degrees) but for the excess heating you require in your heating instructions, I preserve the rights of my Owners/Managers to claim for any extra burden and/or cost they may encounter and to refuse any liability in case the excess heating might not be achieved.

In the course of the forthcoming voyage, it is likely that further quantities of water will settle out and I therefore reserve the right to carry out further water detection procedures in order to establish the total quantity of water in the cargo. On behalf of my Owners/Charterers and Receivers, I note protest with you and hold you fully responsible for all the consequences resulting from the existence of the water loaded with and in the cargo.
